BACKGROUND:

On August 29, 2013, the City Commission approved a five (5) year Lease Agreement with Broward County to lease space in the City’s Public Works Building located at 4900 West Copans Road for a 911 Emergency Dispatch Center, also known as a Public Safety Answering Point (PSAP). On March 22, 2018, the City Commission approved a five (5) year extension to the Lease Agreement with Broward County at the same rent provided for in the original Lease Agreement. Broward County has requested a two (2) year extension of the Lease Agreement; and on September 28, 2023, the City Commission approved an extension to the Lease Agreement with increased fees to reflect current costs (“City Lease Extension”).

DISCUSSION:

On December 12, 2023, the Broward County Commission approved a revised alternate Lease Agreement with language changes to the City Lease Extension (“County Lease Extension”). The version approved by Broward County removed two (2) specific items:  1) the $60,000 penalty if Broward County did not vacate the building at the end of the two (2) year term, and 2) the provision that Broward County would fund the cost of conflict resolution, if such a need were to arrive at the conclusion of the two (2) years. 

RECOMMENDATION:

Staff recommends approval of this resolution.

NOTES:                     Account No. 01-V36212, PSAP Lease Agreement. Revenues include annual rent of $152,200 for FY2024 and $149,200 for FY2025, as well as $295,000 as additional compensation for the County’s contribution to improvements to the City’s HVAC systems.
