A RESOLUTION OF SUPPORT FOR THE SAMPLE ROAD SHARED USE PATHWAY PROJECT CONSISTENT WITH THE REFERENDUM FOR THE TRANSPORTATION SURTAX (“PENNY FOR TRANSPORTATION” PROGRAM) ON NOVEMBER 6, 2018, AND THE TRANSPORTATION SYSTEM SURTAX INTERLOCAL AGREEMENT (ILA) BETWEEN THE BROWARD METROPOLITAN PLANNING ORGANIZATION (MPO) AND THE CITY OF COCONUT CREEK.

BACKGROUND:
On November 6, 2018, the residents of Broward County approved the referendum for the Transportation Surtax (“Penny for Transportation” Program). This program established funding along with an application process for eligible transportation projects. The City of Coconut Creek has submitted a Surtax application for grant funding for a shared use pathway along a segment of Sample Road between Lyons Road and Tradewinds Park (Florida Turnpike). The Sample Road application was evaluated and ranked by the MPO, then vetted to determine programmability in accordance with the Surtax policies.
The existing Sample Road right-of-way limits are under the jurisdiction of the Florida Department of Transportation (FDOT). FDOT is in full support of the project but has assigned the City to be responsible for the design and construction of this improvement. City Staff has been coordinating with our professional engineering consultant along with FDOT for the conceptual design and preliminary cost-estimates of this shared use pathway. The City is pursuing the Surtax funding to aid with financing and budgeting for both the design and construction of the Sample Road Shared Use Pathway.
The Transportation System Surtax Interlocal Agreement (ILA) provided for a cooperative and organized process for municipalities, such as Coconut Creek, to submit projects for evaluation and funding with Surtax proceeds. Moving forward, the City may need to fund upfront Surtax projects’ Design, Construction, Engineering and Inspection (CEI) costs; however, reimbursement is now eligible for each of those fees. The City may still be required to budget a contingency fund for these projects. The City may also be required to deliver and administer project(s) through the Local Agency Program (LAP), either directly or as part of a multi-city collaborative that is currently in process.
DISCUSSION:
In accordance with the ILA Surtax agreement between the MPO the City of Coconut Creek, the municipal applicant is required to provide a resolution of support to the MPO for the Sample Road Shared Use Pathway application. The pathway is consistent with the City’s Complete Streets Policy and provides a needed east/west multiuse trail that connects the Lyons Road Mobility Project to one of Broward County’s largest parks, Tradewinds Park.
RECOMMENDATION:
Staff recommends approval of this resolution.
FISCAL IMPACT:
Upfront design costs to be reimbursed upon acceptance of the LAP project are estimated to be in the amount of approximately $340,900 for FY 2024.
