BACKGROUND:

The City and Seminole Properties II, Inc. currently have an ongoing Use Agreement dated December 14, 2017, that allows the Seminoles to use a portion of Tract E of the Commerce Center for temporary and non-exclusive overflow parking.  That agreement will expire on December 12, 2020 (“Original Agreement”).  Seminole Properties II, Inc. would like to continue to have temporary and non-exclusive use from time to time for the purpose of overflow parking and/or special events sponsored by Seminole Properties and/or the Seminole Tribe of Florida on a portion of City property.

DISCUSSION:

The attached Use Agreement provides Seminole Properties II, Inc. the temporary and non-exclusive use of City property for use during weekends from December 31 to April 30 and for a maximum of four (4) additional times for special events except for the last Saturday in February each year wherein the City shall utilize the property for temporary overflow parking for its Annual Butterfly Festival Event and except for one other time during the use period so long as the City gives Seminole Properties II, Inc. thirty (30) days’ advanced notice in exchange for Seminole Properties II, Inc. maintaining all improvements located on Tract E, paying for all utility service on Tract E, and maintaining the property free of any trash or debris. The agreement has a term of three (3) years, commencing on the date the agreement is signed by the City ("Effective Date") and ending three (3) years thereafter (“Termination Date").

RECOMMENDATION:

Staff recommends approval of this resolution.
