BACKGROUND:

The City and Seminole Properties II, Inc. currently have an ongoing Use Agreement that allows the Seminoles to use a portion of Tract E of the Commerce Center for temporary and non-exclusive overflow parking. Amendment No. 1 to the Use Agreement, dated December 13, 2018 (“Amendment ), was for a period of one (1) year, and will expire on December 13, 2019, but provides for one (1) successive one (1) year term.  The City and Seminoles agree to the City’s use of the property for the annual Butterfly Festival on Saturday, February 29, 2020.

DISCUSSION:

Amendment No. 2 will extend the Use Agreement for a one (1) year term that will expire on December 13, 2019, and will provide for the City’s use of the property for parking for the annual Butterfly Festival on Saturday, February 29, 2020.

RECOMMENDATION:

Staff recommends approval of this resolution.
