A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY MANAGER, OR THEIR DESIGNEES, TO EXECUTE A LIGHTING AGREEMENT WITH BROWARD COUNTY FOR THE INSTALLATION AND MAINTENANCE OF PEDESTRIAN LIGHTING ALONG THE WEST SIDE OF SOUTHBOUND LYONS ROAD BETWEEN WINSTON PARK BOULEVARD AND ATLANTIC BOULEVARD.

BACKGROUND:
The City is committed to maintaining a high quality of life for its residents; and as such, on October 24, 2013, the Coconut Creek City Commission approved Resolution No. 2013-112 in support of the Complete Streets design guidelines to allow all users, including people who walk, bike, use transit, and drive, to safely navigate the City’s roadways.
In addition, on February 26, 2015, the Coconut Creek City Commission approved Resolution No. 2015-045 in support of the Lyons Road Mobility Safety Project to include bicycle lanes, sidewalk, and pedestrian amenities along the Lyons Road corridor between the Sawgrass Expressway and Atlantic Boulevard.
On August 24, 2023, the Coconut Creek City Commission approved Resolution No. 2023-138 to execute the First Amended and Restated Interlocal Agreement for the creation of the Metro Transportation Engineering & Construction Cooperative (MTECC) for the purpose of administering the Lyons Road Pedestrian Lighting project and other federal aid projects, as needed. This resolution further states that the City of Coconut Creek partnered with the Broward Metropolitan Planning Organization (BMPO) to successfully apply for the $3.9 million in federal appropriation funds for pedestrian lighting on Lyons Road.
On June 13, 2024, the Coconut Creek City Commission approved Resolution No. 2024-094 to establish the Tri-Party Agreement between the BMPO, the City of Coconut Creek, and the MTECC, establishing the responsibilities and guidelines for the grant-funded Lyons Road Pedestrian Lighting Safety Project (B-23-CP-FL-0383) thus providing the pedestrian lighting along southbound Lyons Road between Winston Park Boulevard and Atlantic Boulevard.
DISCUSSION:
The portions of Lyons Road from Atlantic Boulevard to Coconut Creek Parkway and from Sample Road north lie within Broward County right-of-way, the County requires that the City execute a lighting agreement prior to performing any work. Under this agreement, the City will assume full responsibility for the installation and on-going operation, maintenance, and repair of the new pedestrian lighting system. The agreement will remain in effect in perpetuity or until terminated in accordance with Article 4 of the agreement.

Staff recommends approval of this resolution.
