BACKGROUND:

The City and the Seminole Tribe of Florida d/b/a Seminole Indian Casino-Coconut Creek (“Seminole”) currently have an ongoing Use Agreement dated December 15, 2020, that allows Seminole to use a portion of Tract E of the Commerce Center of Coconut Creek, owned by the City, for temporary and non-exclusive overflow parking.  That agreement will expire on December 15, 2023 (“Agreement”).  Seminole would like to continue to have temporary and non-exclusive use from time to time for the purpose of overflow parking and/or special events sponsored by Seminole on a portion of City Property.

DISCUSSION:

The attached agreement provides Seminole the continued temporary and non-exclusive use of City Property during weekends from December 31 to April 30 and for a maximum of four (4) additional times for special events, except for the last Saturday in February each year wherein the City shall utilize the property for temporary overflow parking for its Annual Butterfly Festival Event each year and except for one (1) other time during the use period so long as the City gives Seminole thirty (30) days’ advanced notice. In exchange, Seminole will maintain all improvements located on Tract E, pay for all utility service on Tract E, and maintain the property free of any trash or debris. The agreement has a term of five (5) years, commencing on the date the agreement is signed by the City ("Effective Date") and ending five (5) years thereafter (“Termination Date"). Please note, the City retains the right to allocate portions of the lot for specific purposes, including but not limited to, temporary parking for other users completing economic development activities.

RECOMMENDATION:

Staff recommends approval of this resolution.
