A RESOLUTION APPROVING THE SUBMITTAL OF A LETTER FROM THE CITY MANAGER TO BROWARD COUNTY REQUESTING THE CONVEYANCE OF TITLE TO A PORTION OF THE RIGHT-OF-WAY FOR CULLUM ROAD FROM BROWARD COUNTY TO THE CITY OF COCONUT CREEK AS SHOWN AND LEGALLY DESCRIBED IN EXHIBIT “A.”

BACKGROUND:

The City has maintained the Cullum Road right-of-way for many years, but portions of it fall within the jurisdiction of the Florida Department of Transportation (FDOT) and Broward County. City staff has been in communication with each of these agencies to coordinate conveyance of these portions of rights-of-way to the City for the purpose of building-out the streetscape improvements in the MainStreet project area consistent with the City’s MainStreet Design Standards. The transfer of the FDOT parcels has been administratively requested but formal Commission action is required in order to initiate the transfer of the County piece.

DISCUSSION:

The County is the owner of a 20 foot wide portion of the Cullum Road right-of-way near the intersection of NW 54 Avenue. The attached resolution will initiate the Broward County process for conveyance of that right-of-way section. Once approved by Broward County, staff will prepare an ordinance accepting the road right-of-way for consideration at a public hearing before the City Commission.

RECOMMENDATION:

Staff recommends approval of the resolution.
