A RESOLUTION OF SUPPORT FOR THE JOHNSON ROAD SHARED USE PATHWAY PROJECT CONSISTENT WITH THE REFERENDUM FOR THE TRANSPORTATION SURTAX (“PENNY FOR TRANSPORTATION” PROGRAM) ON NOVEMBER 6, 2018, AND THE TRANSPORTATION SYSTEM SURTAX INTERLOCAL AGREEMENT (ILA) BETWEEN THE BROWARD METROPOLITAN PLANNING ORGANIZATION (MPO) AND THE CITY OF COCONUT CREEK.

BACKGROUND:
On November 6, 2018, the residents of Broward County approved the referendum for the Transportation Surtax (“Penny for Transportation” Program). This program established funding along with an application process for eligible transportation projects. The City of Coconut Creek has submitted a Surtax application for grant funding to support the design, construction, inspection, and acceptance of the Johnson Road Shared Use Pathway. The Johnson Road Shared Use Pathway Surtax application was evaluated and ranked by the MPO and vetted to determine programmability in accordance with the Surtax policies. The City was awarded approximately $850,000 through a different Federal program (CSLIP). These funds are not programmed until 2025 and therefore we are pursuing Surtax funding to expedite the project and to cover the increased cost estimate and costs that may not be eligible such as design and CEI.
The Transportation System Surtax Interlocal Agreement (ILA) provided for a cooperative and organized process for the municipalities, such as Coconut Creek, to submit projects for evaluation and funding with Surtax proceeds. Moving forward, the City of Coconut Creek may need to fund upfront Surtax projects’ Design, Construction, Engineering and Inspection (CEI) costs; however, reimbursement is now eligible for each of those fees. The City may still be required to budget a contingency fund for these projects. The City may also be required to deliver and administer project(s) through the Local Agency Program (LAP), either directly or as part of a multi-city collaborative that is currently in the works.
DISCUSSION:
The Johnson Road Shared Use Pathway project is consistent with the City’s Complete Streets Policy. The project provides a multiuse connection between Tradewinds Elementary School and the Recreation Complex. The City is pursuing the necessary funds needed to design, install, and inspect the construction of the shared use pathway along the north side of Johnson Road and extending along Park School Road. In accordance with the ILA Surtax agreement between the MPO the City of Coconut Creek, the municipal applicant is required to provide a resolution of support to the MPO for the Johnson Road Shared Use Pathway Project application.
RECOMMENDATION:
Staff recommends approval of this resolution.
FISCAL IMPACT:
Construction costs are estimated to be in the amount of approximately $1.2 million. Design and CEI costs are to be negotiated, however, it is anticipated that those funds will be reimbursable through the Surtax program. The required contingency will need to be budgeted.
