BACKGROUND:
This item was tabled to a date certain of November 12, 2020, at the October 22, 2020, City Commission Meeting.
Property owners, Randy and Gina Nelson, are requesting a variance from Section 13-379 (1) of the City's Land Development Code to permit a fence within a required front yard where one is not permitted, at 3920 NW 23 Place. The subject property is located in the Coco Pointe section of Centura Parc. This subdivision includes sixty-five (65) single and two-story homes with garages and front yard access along an internal private road. The subject property, however, differs in that the front property line has no street frontage but rather, abuts an adjacent home. A portion of the east side property line abuts the internal road providing access to the home and garage. This distinctive site configuration has created a greater front yard (44'+/-) than typical homes in Coco Pointe (20') and minimizes visibility of the home from the road.
DISCUSSION:
Per Sec.13-379 (1) of the City's Land Development Code, fences on a residential lot shall not be permitted within a required front yard. The owners are requesting a variance to allow the installation of a six-foot (6') shadowbox fence within the front yard. As described in the application, this private area is routinely used by strangers for canal access and parking. As proposed, the property owners wish to secure the front yard and prevent trespassing and damage from vehicles parked within their property. The fence, proposed with a twenty-two foot (22') setback, will run parallel to the east side property line.
