BACKGROUND:
On October 25, 2018, the City Commission approved Resolution No. 2018-247 to enter into an ILA with the City of Pompano Beach, the City of Margate, the City of North Lauderdale, and the City of Coral Springs for sharing the cost of the development of a Bacteria Pollution Control Plan. Due to changes to the language of the ILA required by the City of Pompano Beach, a new resolution is needed to authorize the signing and recording of the ILA. The changes to the ILA are not substantive in nature, and include the following: "Master Consulting Agreement" was replaced by "Service Contract"; "consulting services authorization" was replaced by "scope of work"; "work authorization" was removed from Section E on Page 5 of the scope of work; Page 7 of the scope of work was removed (this is a signature page) because the City of Pompano Beach will use their own signature page; and the term of the agreement was changed from 15 to 12 months.
DISCUSSION:
The City is committed to meeting the requirements of the NPDES MS4 permit. This ILA provides cooperation among the above municipalities (Parties) to develop the required BPCP through cost sharing of the consultant services to be used for its development. The Parties will each provide twenty percent (20%) of the final invoice cost, resulting from the development of the BPCP through the use of the service contract between the Consultant and the City of Pompano Beach.

Staff recommends approval of this resolution.
