TITLE:

title

A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE A LICENSE AGREEMENT WITH VTR PROPERTY, LLC TO PROVIDE THE CITY ACCESS OVER AND ACROSS THE PROPERTY TO THE WATER METERS AT 4515 WILES ROAD.

body

BACKGROUND:

VTR Property, LLC (VTR) has developed and plans to operate the Gupta Medical Office Building located at 4515 Wiles Road. The existing water and wastewater infrastructure within the Banyan Square Plat is privately owned and maintained. As part of the development and construction improvements, the developer, at their cost, installed a water service line and two meter boxes to serve the new building. The water infrastructure will remain private, and the City will provide water services to the property.

DISCUSSION:

The City is committed to ensuring continuity and expansion of utility services and efficient and effective customer service for its residents and businesses. The City will provide water services to the Gupta Medical Office Building, which water usage will be metered for billing purposes by two 1.5-inch water meters located on the property. In order for City staff and its contractors/agents to gain access to the water meters, VTR has agreed to grant a non-revocable license to the City for access to install, maintain or replace, and read the water meters for so long as the City provides water services to the property.

RECOMMENDATION:

Staff recommends approval of this Resolution.
