BACKGROUND:

This item was approved on First Reading at the February 22, 2018, City Commission Meeting.

Sections 402.301 through 402.319, Florida Statutes, establish statewide minimum standards for the care and protection of children in child care facilities, ensure maintenance of these standards, and approve County administration and enforcement of these standards. Pursuant to Section 402.306, Florida Statutes, counties that meet or exceed the minimum state standards may designate a local licensing agency aside from the Department of Children and Families to manage child care facilities locally. Broward County, through the enactment of the "Broward County Child Care Ordinance," adopted relevant laws that exceed the minimum state standards, and therefore has administration and enforcement authority over such facilities. Broward County carries out these functions through the Broward County Child Care Licensing and Enforcement Section.
DISCUSSION:
Broward County is continuously reviewing and improving the regulations applicable to child care facilities located in the County. As recent as January 9, 2018, with the passage of Broward County Ordinance No. 2018-02, the County enacted or amended various provisions within its Code to ensure the safety of children enrolled in child care facilities. Chapter 7, "Child Care Centers," of the City's Code of Ordinances was enacted in the 1980s and is superseded by the County and State laws on the subject. In order to remove outdated and obsolete standards and regulations, City staff recommends repealing Chapter 7, "Child Care Centers," in its entirety.
RECOMMENDATION:
Staff recommends approval of this Ordinance.
