BACKGROUND:

This item was approved on First Reading at the September 14, 2017, City Commission Meeting.

In light of the new law passed during the 2017 Special Legislative Session and signed into law by the Governor under Chapter 2017-232, Laws of Florida, which became effective on June 23, 2017, the treatment of pharmacies and medical marijuana dispensaries are under scrutiny. In an effort to be proactive in addressing Medical Marijuana Treatment Centers within the City, the City enacted Ordinance 2017-009. However, with the passage of this recent State law, the City must revisit several components of not only that Ordinance, but other regulations within the City's Land Development Code.

DISCUSSION:

One aspect of the City's Land Development Code that needs clarification is the treatment of drug stores/pharmacies. With guidance from the State Statutes and research of local laws, the City intends to provide for the location of such use within certain zoning districts as a special land use.

RECOMMENDATION:

The Planning and Zoning Board, at its July 12, 2017, meeting, recommended approval of the proposed amendment.
