BACKGROUND:
In 2005, the City Commission adopted Ordinance No. 2005-032, requiring the underground placement of all utilities for any new commercial, industrial, or retail development seeking site plan approval, or for new residential development of five (5) acres or more seeking site plan approval. All utilities, including existing overhead utilities, located within or in the public rights-of-way adjacent to the site must be installed underground, unless an underground utility waiver is granted by the City Commission.
DISCUSSION:
On May 11, 2016, the Planning and Zoning Board approved the site plan application for the proposed Clarity Pointe memory care facility located at 5461 Johnson Road.
The subject property is approximately 5.12 +/- gross acres with approximately 330 linear feet of existing overhead utility lines within the Johnson Road right-of-way, running along the southern boundary of the site. Based on an analysis by Florida Power and Light (FPL), conversion of the existing overhead utilities for such a short span would create an excessive amount of potential points of failure and severely impact the service reliability to the surrounding community. FPL further determined that it would be more practical to have these facilities converted to underground as part of a larger project for the Johnson Road corridor. The City is planning on undertaking such a project and has budgeted for the undergrounding of the overhead lines along Johnson Road, which is scheduled to begin next year. Any payment from Clarity Pointe into the City's Underground Utility Fund will be directed to this project.
