BACKGROUND:

Several associations have requested to contract with the City for traffic and parking enforcement; and as a result, over the past several months staff has been working to research the feasibility of providing these services in private communities.  The City Commission held public workshops on February 11, 2016, and July 28, 2016, to discuss the findings of the research and gather input from the public.  Minutes of those workshops are attached for reference.

Section 316.006(2)(b), Florida Statutes, allows for a private property owner to contract with local government to exercise jurisdiction regarding traffic control and enforcement over private or limited access roads owned or maintained by the private party.

DISCUSSION:

At the July 28, 2016, Workshop, the Commission gave consensus for staff to bring forth a form agreement to provide traffic and parking enforcement in private communities. The attached form Agreement provides for the terms and conditions to provide these services to private neighborhoods.  Enforcement would be undertaken by the City’s Police Department on a call-driven basis for a term that begins upon execution of the Agreement and remains in effect until rescinded.

RECOMMENDATION:

Staff recommends approval of this Resolution.
