BACKGROUND:

Section 1-19 of the Broward County Code of Ordinances codifies the “Broward County Elected Official Code of Ethics” (Ethics Code), which is applicable to all municipal elected officials, their specified relatives, and their office staff. As provided by the Ethics Code, each time that a City Commissioner solicits a charitable contribution on behalf of a non-profit charitable organization, the Commissioner must complete a form that discloses the activity within fifteen (15) days. The Ethics Code provides an exception to the reporting requirement wherein certain lawful solicitation does not need to be disclosed if the organization or event has been formally approved by the official’s governmental entity.

DISCUSSION:

The exception is plainly provided for in the Ethics Code pursuant to Section 1-19(c)(5)a.4. To exercise this exception, the proposed Resolution will formally approve specific non-profit charitable organizations and City-sponsored events for purposes of lawful solicitation. In formally approving the listed organizations and City-sponsored events, the City Commission is allowing each Commissioner to solicit on behalf of those organizations without the need to file a disclosure for each act of lawful solicitation within fifteen (15) days.

RECOMMENDATION:

Staff recommends approval of this Resolution.
