BACKGROUND:

The City recognizes that there is a constitutional right to solicit and peddle; however, the City may adopt and enforce regulations of behavior that implicate First Amendment activity when the regulations affecting the time, place, and manner of expression are content-neutral, and narrowly tailored to serve a significant government interest.

DISCUSSION:

The City Commission has a significant interest in protecting our residents’ privacy and preventing fraud by requiring that solicitors obtain an identification badge and permit to engage in soliciting activities.  This amendment clarifies the requirements to obtain a permit, when a permit may be denied, and the appellate rights of the permittee.

RECOMMENDATION:

Staff recommends approval of this Ordinance.
