BACKGROUND:

This item was approved on First Reading at the July 28, 2016, Commission Meeting.

Recent case law has prompted the City to review its Land Development Code and remove obsolete and outdated terms and consolidate redundant terms in order to make them consistent with State and Federal laws. To that end, the City desires to amend Chapter 13, the City’s Land Development Code, by amending Section 13-295, “Definitions,” in order to provide for the consolidation of terms originating from the proposed repealed Sections 13-300 through 13-303 pertaining to special facilities, as well as add to and update the existing terms to provide clarity and specificity.  As part of this proposed package, the new terminology was added in the relevant Land Development Code sections including, but not limited to, Division 3, “Zoning District Regulations and Tables” and Division 8, “Master Business List.”

DISCUSSION:

The City is committed to updating its Land Development Code to make it consistent with State and Federal laws. The proposed amendments will locate all definitions within Section 13-295, “Definitions,” of the City’s Land Development Code in order to make it more streamlined and easier to use.

RECOMMENDATION:

The Planning and Zoning Board, at its June 8, 2016, meeting, recommended approval.
