BACKGROUND:

This item was approved on First Reading at the July 28, 2016, Commission Meeting.

Recent case law has prompted the City to review its Land Development Code and remove obsolete and outdated terms and consolidate redundant terms pertaining to special facilities in order to make it consistent with State and Federal laws. To that end, the City desires to amend Chapter 13 of the City’s Land Development Code by repealing Section 13-300, “Special facilities,” Section 13-301, “Definitions; special facilities,” Section 13-302, “Special facility zoning,” and Section 13-303, “Special facilities development regulations.”  The relevant terms and standards pertaining to special facilities were updated and moved to or consolidated with other sections of the City’s Land Development Code including, but not limited to, Section 13-295, “Definitions.” As part of this proposed package, references to the repealed language were eliminated in the relevant Land Development Code sections including, but not limited to, Division 3, “Zoning District Regulations and Tables” and Division 8, “Master Business List.”

DISCUSSION:

The City is committed to updating its Land Development Code to make it consistent with State and Federal laws pertaining to special facilities. Therefore, the City desires to amend the Land Development Code by repealing Sections 13-300 through 13-303 in their entirety and providing for updated terms and standards consistent with current laws in the appropriate sections of the City’s Code.

RECOMMENDATION:

The Planning and Zoning Board, at its June 8, 2016, meeting, recommended approval.
