BACKGROUND:
This item was approved at the First Public Hearing at the July 28, 2016, Commission Meeting.
Recent case law has prompted the City to review its Land Development Code and remove obsolete and outdated terms and consolidate redundant terms in order to make them consistent with State and Federal laws. To that end, the City desires to amend Chapter 13, the City's Land Development Code, by amending the list of permitted and special land uses in the following zoning districts: Agricultural (A-1), Residential (RS-1, "residential single family detached district;" RS-3, "residential single family detached district;" RS-4, "residential single family detached district;" RS-5, "residential single family detached district;" RC-5, "residential cluster district;" RC-8, "residential attached district;" RM-10, "residential multiple-family district"), Mobile Home Park (MH-1), Community Facility (CF), Business (B-2, "convenience shopping district;" B-3, "community shopping district;" B-4, "regional shopping district"), Industrial (IO-1, "industrial office district;" IM-1, "industrial manufacturing district"), and Office (O-2, "local office district;" O-3, "regional office district"); and repeal the Planned Unit Development (PUD) zoning district master business list in its entirety. Such proposed amendments will add to and update the existing permitted and special land uses within the above zoning districts to provide clarity and specificity.
