BACKGROUND:

This item was approved on First Reading at the July 23, 2020, City Commission Meeting. 

The City desires to amend Chapter 13 of the Code of Ordinances, relating to the City’s “Reasonable Accommodation” procedure by amending Section 13-41, “Requests for Accommodation,” of the City’s Code of Ordinances.  The City initially provided a process for seeking Reasonable Accommodation back in 2015 to bring the Land Development Code into compliance with federal law.   

DISCUSSION:

The ordinance updates application information requirements and evaluation standards to track the most current case law, requires state licensure or certification when seeking accommodation from the definition of family, provides a process for revocation of a reasonable accommodation approval, and revises the appeal process to provide for appellate review by the Special Magistrate.  The amendment also provides a requirement for annual administrative re-certification of a reasonable accommodation approval to ensure on-going compliance with license, certification, and code requirements. 

RECOMMENDATION:

The Planning and Zoning Board recommended approval of these amendments at its March 11, 2020, meeting.
