A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE THE ATTACHED MAINTENANCE AGREEMENT WITH COCOMAR PROPERTY OWNER, LLC, WHICH AGREEMENT PROVIDES FOR CITY ENFORCEMENT OF THE REVOCABLE LICENSE AGREEMENT BETWEEN BROWARD COUNTY, COCOMAR PROPERTY OWNER, LLC, AND THE CITY OF COCONUT CREEK FOR THE MAINTENANCE OF SIDEWALKS, LANDSCAPING, AND OTHER IMPROVEMENTS IN THE LYONS ROAD RIGHT-OF-WAY ADJACENT TO THE PROPERTY LOCATED AT THE NORTHWEST CORNER OF ATLANTIC BOULEVARD AND LYONS ROAD KNOWN AS THE GREYSTAR COCOMAR PROJECT.

BACKGROUND:
In November 2023, the City of Coconut Creek City Commission approved a site plan application for the development of an office/warehouse development complex located on the north side of Atlantic Boulevard at the northwest corner of Lyons Road. The approved site plan provided for public improvements along the Lyons Road frontage within Broward County right-of-way (ROW), including but not limited to, a non-standard County sidewalk (shared-use path), landscaping, and irrigation (collectively referred to herein as "ROW Enhancements"). In order to complete those ROW Enhancements in the County ROW, the County required execution of the Revocable License Agreement Between Broward County, Cocomar Property Owner, LLC, and the City of Coconut Creek (the "Revocable License Agreement"). The Revocable License Agreement was approved by the City Commission on February 26, 2026. DISCUSSION:
The current agreement incorporates the Revocable License Agreement and provides the City with remedies to ensure the fulfillment of the maintenance responsibility for the proposed ROW Enhancements by the property owner, Cocomar Property Owner, LLC (the "Property Owner"). All improvements included in the agreement will be constructed and maintained by the Property Owner, in accordance with Broward County standards and City requirements, providing for the long-term maintenance of the Lyons Road corridor.
