BACKGROUND:
The City owns the communications tower ("Tower") located within the City's Lakeside Park located at 5555 Regency Lakes Boulevard, Coconut Creek, Florida, and leases space to several tenants via lease agreements.
On December 9, 2004, the City Commission authorized the Mayor to execute the original space lease agreement ("Agreement") with T-Mobile South, LLC ("T-Mobile") for the purpose of leasing space on the Tower together with a portion of the City's land adjacent to the Tower to install, operate, and maintain communications equipment on the Tower.
On April 24, 2008, the City Commission authorized the Mayor to execute the First Amendment to the Agreement ("First Amendment"), which provided for the modification of the existing equipment.
On February 26, 2015, the City Commission authorized the Mayor to execute the Second Amendment to the Agreement ("Second Amendment"), which provided for a modification to remove and replace the T-Mobile equipment on the Tower.
On January 24, 2019, the City authorized the Mayor to execute the Third Amendment to the Agreement ("Third Amendment"), which provided for the removal of the existing generator and installation of a new twenty-five (25) kilowatt generator within the existing space.
DISCUSSION:
The City and T-Mobile desire to amend the Agreement a fourth time to modify the equipment on the Tower, which will increase the loading factor on the Tower by three and a half percent (3.5%).
