BACKGROUND:

In April 2023, the City Commission adopted Ordinance No. 2023-003, which amended Chapter 12, “Garbage and Refuse,” of the City Code to reflect changes in recycling processes and state law. These amendments included the renumbering of several sections within Chapter 12; however, the renumbered Chapter 12 sections were not automatically updated within Section 1-8. As a result, certain citations within the penalty schedule no longer clearly align with the current Code structure. Staff review identified the need to clarify that the penalties listed in Section 1-8 apply to all violations of Chapter 12 unless otherwise expressly stated.

DISCUSSION:

The proposed ordinance updates Section 1-8 of the City Code to update outdated section references related to Chapter 12 and ensures that the penalty schedule accurately corresponds with the renumbered provisions adopted under Ordinance No. 2023-003. The amendments also add clarifying language, confirming the applicability of fines to all provisions of Chapter 12 unless otherwise specified. These revisions are strictly administrative in nature and are intended to maintain internal consistency within the City Code, reduce ambiguity for enforcement personnel, and ensure proper application of penalties for code violations.

RECOMMENDATION:

Staff recommends approval of this ordinance.
