A RESOLUTION AUTHORIZING THE CITY MANAGER TO REQUEST THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) TO CONVEY SURPLUS PROPERTIES AND EASEMENTS TO THE CITY OF COCONUT CREEK TO BE UTILIZED FOR THE PUBLIC PURPOSE OF PROVIDING DRAINAGE FACILITIES AND ROAD RIGHT-OF-WAY WITHIN THE MAINSTREET PROJECT AREA, AS PROVIDED HEREIN AND LEGALLY DESCRIBED IN EXHIBIT “A.”

body

BACKGROUND:

The Florida Department of Transportation (FDOT) owns various properties and easements used for drainage and right-of-way within the MainStreet Project Area (MSPA). Pursuant to Section 337.25(4)(b), Florida Statutes, FDOT may convey surplus property to another government agency, at no cost, subject to use of the property for public purpose.

DISCUSSION:

This resolution will declare the public purpose for each of the parcels and easements identified and authorize the City Manager to request they be transferred to the City.

Exhibit “A” identifies the eight (8) Parcels, which are generally located along the western end of Cullum Road and NW 54 Avenue, and the chart below identifies the public purpose for each Parcel.  In most cases, the City has already been maintaining these areas for an extended period of time.  Upon the City’s request, FDOT will declare these parcels as surplus and transfer them to the City.
