A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE A TERMINATION AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION RELATED TO THE MAINTENANCE OF STREET LIGHTS.

BACKGROUND:

In 2004, the City entered into an Agreement with the Florida Department of Transportation (FDOT) to maintain the street lights on state roads within the City. Approximately one year ago, the City’s electrical contractor received a significant shock event while working on one of the lights. Upon further investigation, it was revealed that many of the street lights were never properly grounded, and the ones that were grounded were not in compliance with current National Electric Code standards. City staff met with FDOT officials on several occasions and requested that FDOT either properly ground the poles and fixtures or provide the funding so that the City could properly ground the poles and fixtures. In consideration of this safety issue, City staff further informed FDOT that the aforementioned deficiencies needed to be addressed if they wanted the City to perform any further maintenance or repair work. To that end, FDOT has determined that it is in their best interest to terminate the Agreement and assume all future responsibility for maintenance of their street light facilities.

DISCUSSION:

FDOT has determined that assuming responsibility for maintenance and repair of their streetlight facilities is in their best interest.  In the absence of FDOT addressing the aforementioned deficiencies, City staff agrees with their determination.

RECOMMENDATION:

Staff recommends approval of the Resolution.
