BACKGROUND:

On February 26, 2015, the City Commission approved Ordinance No, 2015-009 prohibiting hydraulic fracturing, acid fracturing, and extreme well stimulation (“fracking”) within the City of Coconut Creek.  City staff was recently made aware of proposed legislation (HB 191 and SB 318) that proposes to enact regulations permitting fracking, drilling and oil and gas exploration in the State of Florida and proposes to preempt such regulation to the State of Florida, Department of Environmental Protection, retroactive to January 1, 2015, thereby nullifying the City’s Ordinance.

DISCUSSION:

The City is committed to preserving the public health, safety, and welfare of its citizens.  Further, it is vehemently opposed to HB 191, SB 318 and any and all other similar legislation permitting fracking and drilling statewide and prohibiting local regulation of fracking and drilling by providing for retroactive pre-emption by the State.

RECOMMENDATION:

Staff recommends approval of this Resolution opposing HB 191, SB 318, and any and all other similar Legislation enacting State regulations permitting hydraulic fracturing, acid fracturing, high-pressure well stimulation, oil and/or gas drilling, production and/or transportation and providing for preemption by the State retroactively.
