BACKGROUND:

At the November 9, 2023 City Commission meeting, the City Commission adopted Resolution No. 2023-097, which approved the site plan request for the development of a light industrial, flex space, and warehouse project generally located at the northwest corner of Atlantic Boulevard and Lyons Road. The site plan approval included several conditions, including Condition 5.i., which requires the applicant to construct and install solar lighting fixtures and a solar electronic device charging station within Coco Point Park at the applicant’s sole expense. The condition further requires the applicant to provide perpetual maintenance of these improvements.

DISCUSSION:

To fulfill Condition 5.i., the applicant must access Coco Point Park to install the required solar lighting and charging station and to conduct ongoing maintenance. The Temporary Construction and Permanent Access and Maintenance Easement Agreement, attached as Exhibit “1,” provides the necessary legal access rights and maintenance plan for the applicant to complete the installations and maintain the fixtures thereafter.

RECOMMENDATION:

Staff recommends approval of this resolution.

FISCAL IMPACT:  N/A
