BACKGROUND:
In June 2015, a settlement agreement (hereinafter "Agreement") was reached and effectively resolved the litigation filed under case styled City of Sunrise, et al. v. Broward County, Broward County Case No. CACE-013-015660, pertaining to the equitable distribution of the assets and liabilities of the Broward Solid Waste Disposal District. The Agreement provided for the sale of a vacant parcel of land known as the Alpha 250 property. The Alpha 250 property is situated off of Blount Road in Pompano Beach, Florida.
DISCUSSION:
Due to recent changes in the local solid waste industry, the discussion of Broward County residents' solid waste disposal needs in future years has resurfaced. On June 14, 2016, the Broward County Commission approved a motion to amend the Agreement to delay the sale of the Alpha 250 property for one (1) year from the First Amendment's effective date, and may be further extended for one (1) year thereafter if provided for in writing, to allow time for a joint independent study to be conducted on that subject matter. The First Amendment provides that the study will focus on the future needs for solid waste disposal and recycling within Broward County and shall cost no more than $200,000. The County has proposed that it will pay for the study up-front, but only if the municipalities pay half of those expenses through proceeds generated from the sale of the property or a comparable reduction off the net sale price if the County were to purchase the land for itself.
RECOMMENDATION:
Staff recommends approval of the Resolution authorizing the Mayor and the City Manager, or designee, to sign the First Amendment to the subject Settlement Agreement.
