A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE AMENDMENT NUMBER ELEVEN (11) TO THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) DISTRICT FOUR LANDSCAPE INCLUSIVE MAINTENANCE MEMORANDUM OF AGREEMENT TO PROVIDE FOR MAINTENANCE OF SIDEWALKS, LANDSCAPING, AND OTHER RELATED IMPROVEMENTS WITHIN THE ATLANTIC BOULEVARD (STATE ROAD 814) RIGHT-OF-WAY IN CONNECTION WITH THE GREYSTAR COCOMAR DEVELOPMENT PROJECT LOCATED AT THE NORTHWEST CORNER OF ATLANTIC BOULEVARD AND LYONS ROAD.

BACKGROUND:
On November 9, 2023, the City of Coconut Creek approved a site plan application submitted by HSQ Group on behalf of then property owner, Coolidge, Inc., for improvements along the north side of Atlantic Boulevard at the northwest corner of Lyons Road. The proposed public improvements along Atlantic Boulevard, which include but are not limited to, a non-standard Florida Department of Transportation (FDOT) sidewalk, landscaping, and irrigation, encroach into the FDOT right-of-way. FDOT has requested an amendment to the previously-approved District Four Landscape Inclusive Maintenance Memorandum of Agreement (MMOA) to allow the developer to construct the above-described improvements within the Atlantic Boulevard right-of-way.
DISCUSSION:
The City seeks to provide enhanced corridor amenities consistent with the approved Greystar Cocomar Development Project site plan and ensure proper long-term maintenance of the public improvements along Atlantic Boulevard. The proposed improvements are generally located within FDOT's Atlantic Boulevard right-of-way and/or on property owned by Cocomar Property Owner, LLC, with design elements exceeding typical FDOT standards.
