BACKGROUND:

In May of 2009, the City entered into an Inclusive Memorandum of Agreement with the Florida Department of Transportation (FDOT) for the purpose of maintaining certain landscape improvements on various State Roads, including Hillsboro Boulevard.  The agreement includes provisions for adjacent property owners to construct additional improvements in the limits of the identified rights-of-way. 

DISCUSSION:

Leder Hillsboro CO LTD, as the adjacent property owner, is desirous of constructing off-site landscape and pedestrian improvements to enhance the public right-of-way on Hillsboro Boulevard, adjacent to the Leder Hillsboro project located at 4171 and 4181 Hillsboro Boulevard.   These improvements are consistent with the vision adopted for this area. FDOT does not object to the construction of the improvements but requires that the City accept maintenance responsibility for such improvements by amending the above referenced Inclusive Memorandum of Agreement.

By a concurrent separate agreement also presented for the City Commission’s consideration on this agenda, the maintenance is assigned to the developer.

RECOMMENDATION:

Staff recommends approval of this resolution.
