A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE THE ATTACHED MAINTENANCE AGREEMENT BETWEEN THE CITY OF COCONUT CREEK AND HILLSBORO MARKETPLACE INVESTMENTS, LLC, WHICH AGREEMENT TRANSFERS AND ASSIGNS RESPONSIBILITIES FOR THE MAINTENANCE OF SIDEWALKS, LANDSCAPING, AND OTHER IMPROVEMENTS IN THE WEST HILLSBORO BOULEVARD (STATE ROAD 810) RIGHT-OF-WAY ADJACENT TO THE PROPERTY LOCATED AT WEST HILLSBORO BOULEVARD AT THE NORTHWEST CORNER OF LYONS ROAD TO HILLSBORO MARKETPLACE INVESTMENTS, LLC.

BACKGROUND:
In September 2021, the City of Coconut Creek approved a site plan application submitted by The Keith Company on behalf of Hillsboro Marketplace Investments, LLC, for modifications to the shopping center located on the north side of Hillsboro Boulevard at the northeast corner of Lyons Road. The approved site plan provided for public improvements along the West Hillsboro Boulevard frontage within the Florida Department of Transportation (FDOT) right-of-way (ROW), including, but not limited to, a non-standard FDOT sidewalk (shared-use pathway), landscaping, and irrigation (collectively referred to herein as "ROW enhancements").
DISCUSSION:
FDOT requires a local government to accept the maintenance of materials and other improvements installed within its right-of-way when those improvements exceed the FDOT standards. This action corresponds with Resolution No. 2025-162, which authorizes execution of Amendment Number Twelve (12) to the FDOT District Four Inclusive Landscape Maintenance Memorandum of Agreement (MMOA), providing for the identified ROW enhancements.
In turn, this agreement assigns the maintenance responsibility for the proposed ROW enhancements to Hillsboro Marketplace Investments, LLC. All improvements included in this agreement will be constructed and maintained by Hillsboro Marketplace Investments, LLC, in accordance with FDOT standards and City requirements.
