BACKGROUND:
The Florida's Turnpike Enterprise ("FTE") intends to widen a 5.5 mile segment of Florida's Turnpike/State Road 91 in Coconut Creek from Atlantic Boulevard to Wiles Road under Project No. 406150-1 by adding four (4) new express lanes in a shift wholly westward of the center line towards Coconut Creek. FTE also plans to expand the Sawgrass Expressway from US 441 to Powerline Road under Project Nos. 437153-1 and 437224-1, as well as expand the SW 10th Street Connector under Project Nos. 415927-1 and 418214-1. These projects will have a disproportionate negative impact on the adjacent communities, including, but not limited to, increased noise, air pollution, traffic congestion, decreased light, and physical encroachment into the communities.
DISCUSSION:
The City of Coconut Creek requested FTE to reconsider the westward shift or, in the alternative, consider limiting the expansion to a total of eight (8) lanes instead of ten (10) lanes on the Turnpike's mainline. This was rejected by FTE. Through this resolution, the City desires to give direction to the City Attorney to engage the legal services of Ralph DeMeo of Guilday Law to file a lawsuit on behalf of the City, as Plaintiffs, seeking appropriate relief to challenge FTE's plan to expand Florida's Turnpike/State Road 91 from Atlantic Boulevard to Wiles Road under Project No. 406150-1, and expand the Sawgrass Expressway from US 441 to Powerline Road under Project Nos. 437153-1 and 437224-1, as well as expand t...
