BACKGROUND:

The City of Coconut Creek (City) is located adjacent to property owned by Waste Management Inc. of Florida (WMIF) that contains the Monarch Hill Landfill.  In 2015, the City and WMIF entered into a Settlement Agreement dated April 9, 2015, as approved by Resolution No. 2015-079, related to and limiting disposal of waste at the landfill. 

DISCUSSION:

During the recent Broward County Commission Meeting to set the public hearing for several proposed ordinances related to the Monarch Hill Landfill expansion, including adoption of a proposed small-scale amendment to the Broward County Land Use Plan map (PC 22-5) located in the Broward Municipal Services District, adoption of a proposed Code amendment pertaining to waste limitation, and adoption of a proposed Code amendment pertaining to height limitations for landfills, Broward County staff urged and agreed to facilitate a meeting with the City and WMIF.  Following that meeting, City staff has been working collaboratively on an amendment to our existing settlement agreement with WMIF.  The draft amendment provides for limiting waste, eliminating future expansion, implementing a comprehensive groundwater monitoring program, and funding City recycling and solid waste education, innovation, and operational activities.   

RECOMMENDATION:

Staff recommends that the City Commission review and evaluate the attached First Amendment to the Settlement Agreement.
