BACKGROUND:

Broward County is the owner of a portion of the right-of-way for NW 15^th Street (from Lyons Road to NW 44^th Avenue) and NW 44^th Avenue (from NW 15^th Street to Coconut Creek Parkway) within the City of Coconut Creek, on the north and east sides of Coconut Creek High School, pursuant to two Right-of-Way Deeds dated August 24, 1971, recorded in O.R. Book 4606, Page 997 (folio #484229010101), and November 23, 1971, recorded in O.R. Book 4710, Page 860 (folio #484229010102), of the Public Records of Broward County, Florida. The City has been maintaining these right-of-ways for almost fifty (50) years.  The right-of-way was deeded to the County by two separate deeds with half of the right-of-way width in one deed and half of the right-of-way width in the second deed.  As such, the right-of-way is identified as two separate properties in the attached Exhibit.

DISCUSSION:

It is in the best interest of the City to legally own the right-of-way of NW 15^th Street and NW 44^th Avenue to facilitate repairs and necessary maintenance.

RECOMMENDATION:

Staff recommends approval of this resolution.
