BACKGROUND:

Broward County is the owner of a portion of the right-of-way for NW 15th Street (from Lyons Road to NW 44th Avenue) and NW 44th Avenue (from NW 15th Street to Coconut Creek Parkway) within the City of Coconut Creek, on the north and east sides of Coconut Creek High School, pursuant to two Right-of-Way Deeds dated August 24, 1971, recorded in O.R. Book 4606, Page 997 (folio #484229010101), and November 23, 1971, recorded in O.R. Book 4710, Page 860 (folio #484229010102), of the Public Records of Broward County, Florida. The City has been maintaining these right-of-ways for almost fifty (50) years.  The right-of-way was deeded to the County by two separate deeds with half of the right-of-way width in one deed and half of the right-of-way width in the second deed.  As such, the right-of-way is identified as two separate properties in the attached Exhibit.

DISCUSSION:

It is in the best interest of the City to legally own the right-of-way of NW 15th Street and NW 44th Avenue to facilitate repairs and necessary maintenance.

RECOMMENDATION:

Staff recommends approval of this resolution.
