BACKGROUND:
This item was approved on First Reading at the May 28, 2020, City Commission Meeting.
Broward County was the owner of a portion of the right-of-way for NW 45 Avenue within the City of Coconut Creek, pursuant to a Right-of-Way Deed dated March 3, 1960, recorded in O.R. Book 1864, Page 533, of the Public Records of Broward County, Florida. The City owns and has been maintaining the balance of the right-of-way for NW 45 Avenue the City’s incorporation in 1967. On September 12, 2019, the City Commission approved Resolution No. 2019-207 requesting transfer of the above described right-of-way to the City. The Broward County Commission approved Resolution No. 2020-124 on March 31, 2020, approving quitclaim deeds transferring each of the two (2) segments of right-of-way to the City of Coconut Creek. The deeds have subsequently been executed and recorded in the Broward County Public Records on April 20, 2020, as Instrument Number 116466475 and Instrument Number 116466476. Section 310 of the City of Coconut Creek Charter requires that where the City desires to acquire real property by purchase, dedication or condemnation, it shall do so by ordinance.
DISCUSSION:
It is in the best interest of the City to accept the attached Quitclaim Deeds and to thereby legally own the entire right-of-way of NW 45 Avenue to facilitate repairs and necessary maintenance.
RECOMMENDATION:
Staff recommends approval of this ordinance.
