BACKGROUND:

The applicant, Pompano Autoplex, LLC, is seeking approval for a vacation of easement, which is a 12-foot water and utility easement located within a portion of Tract B, Tartan Coconut Creek Phase IV Plat.

The property owner wishes to redevelop the existing site, making site modifications, including the original building configuration.  As such, the proposed development conflicts with the identified water and utility easement.

DISCUSSION:

The City’s Development Review Committee (DRC) has reviewed this request in conjunction with the proposed site plan. The City’s Utilities and Engineering Department will coordinate with the applicant on the relocation of utilities that may be located within the vacated easement and the recordation of any new easements that may be necessary for relocated utilities.  This easement was dedicated solely to the City and no other utility companies have a right to utilize the easement; therefore, a letter of no objection is not required by other utilities. City staff finds that the above described easement vacation is in the best interest of the public welfare.

RECOMMENDATION:

 Staff recommends approval of this resolution.
