A RESOLUTION AUTHORIZING THE CITY MANAGER TO REQUEST THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) TO CONVEY SURPLUS PROPERTY TO THE CITY OF COCONUT CREEK TO BE UTILIZED FOR THE PUBLIC PURPOSE OF PROVIDING ADEQUATE DRAINAGE, UTILITIES, AND ROAD RIGHT-OF-WAY WITHIN THE MAINSTREET PROJECT AREA, AS PROVIDED HEREIN AND LEGALLY DESCRIBED IN EXHIBIT “A.”

body

BACKGROUND:

The Florida Department of Transportation (FDOT) owns various properties used for drainage, utilities, and road right-of-way within the MainStreet Project Area (MSPA). Pursuant to Section 337.25(4)(b), Florida Statutes, FDOT may convey surplus property to another government agency, at no cost, subject to use of the property for public purpose.

DISCUSSION:

This resolution will declare the public purpose for Parcel 136, which is generally located along the western end of Cullum Road, east of State Road 7, and authorize the City Manager to request the parcel be transferred to the City.

The public purpose for Parcel 136 is to provide adequate drainage, utilities, and road right-of-way.  The City has already been maintaining the area for an extended period of time. Upon the City’s request, FDOT will declare Parcel 136 as surplus and transfer it to the City.

RECOMMENDATION:

Staff recommends approval of this resolution.
