BACKGROUND:

On November 18, 2010, the City entered into a Water and Wastewater Agreement with Broward County (herein referred to as “Developer”) for Tradewinds Park. In the original agreement, the water and wastewater impact fees equating to 15 ERCs, were reserved and paid in full for City water and wastewater service. Per the Water and Wastewater Agreement, ownership and maintenance of both the water and wastewater facilities, once constructed by the Developer and approved by the City, are to be transferred by Bill of Sale to the City.

DISCUSSION:

The City is committed to ensuring continuity and expansion of utility services, as well as efficient and effective customer service. Based on the cost savings, the Developer elected to install a forcemain with grinder stations for wastewater instead of gravity sewer. The Developer’s wastewater design meets industry standards but does not meet City standards. Therefore, both parties have agreed on the First Amendment to the Water and Wastewater Agreement where, for the portion of Tradewinds Park located north of Sample Road, only the water facilities will be transferred to the City’s ownership; and the wastewater facilities are to remain owned and maintained by the Developer. This amendment will not result in any change in the amount of ERCs or payment tendered by Developer to the City.

RECOMMENDATION:

Staff recommends approval of this resolution.
