A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE THE ATTACHED MAINTENANCE AGREEMENT WITH 4161 HILLSBORO, LLC, WHICH AGREEMENT TRANSFERS AND ASSIGNS RESPONSIBILITIES FOR THE MAINTENANCE OF SIDEWALKS, LANDSCAPING, AND OTHER IMPROVEMENTS IN THE WEST HILLSBORO BOULEVARD (STATE ROAD 810) RIGHT-OF-WAY ADJACENT TO THE PROPERTY LOCATED AT 4161 WEST HILLSBORO BOULEVARD.

BACKGROUND:
In October 2022, the City of Coconut Creek approved a site plan application for 4161 Hillsboro, LLC for a self-storage facility located at 4161 West Hillsboro Boulevard. The site plan provided for public improvements along the Hillsboro Boulevard frontage within the Florida Department of Transportation (FDOT) right-of-way (ROW), including, but not limited to, a non-standard FDOT sidewalk, landscaping, and irrigation (“ROW enhancements”).
DISCUSSION:
FDOT requires a local government to accept the maintenance of materials installed in their right-of-way, which agreement is also scheduled on this agenda for consideration via Resolution No. 2025-002, approving the tenth amendment to the FDOT District Four Landscape Inclusive Memorandum of Maintenance Agreement (MMOA) to provide for the identified ROW enhancements.
In turn, this agreement will assign the maintenance responsibility for the ROW enhancements to the property owner, 4161 Hillsboro, LLC, or their successor. All improvements included in this agreement will be constructed and maintained by 4161 Hillsboro, LLC.
RECOMMENDATION:
Staff recommends approval of this resolution.
