BACKGROUND:
The United States Environmental Protection Agency (EPA) requires counties and associated municipalities to comply with conditions of the National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) permit program. The NPDES MS4 permit requires the development of a Bacteria Pollution Control Plan (BPCP) to address pollution levels within an EPA-designated impaired waterbody of the permittees' choice through a prioritization process. The EPA encourages municipalities to work together to prepare the BPCP. The City of Coconut Creek only had one EPA-designated impaired waterbody, the C-14 Cypress Creek Canal. In 2017, the municipalities listed in this ILA all chose to prioritize the C-14 Cypress Creek. Pompano Beach offered to be the lead agency in the undertaking to develop the required BPCP and to use Hydro Solutions Consulting, LLC (Consultant) as a consultant in the development process. Hydro Solutions Consulting, LLC entered into a Master Consulting Agreement with Pompano Beach on March 14, 2018.
DISCUSSION:
The City is committed to meeting the requirements of the NPDES MS4 permit. This ILA provides cooperation among the above municipalities (Parties) to develop the required BPCP through cost sharing of the consultant services to be used for its development. The Parties will each provide twenty percent (20%) of the final invoice cost, resulting from the development of the BPCP through the use of the Consultant Work Authorization between the Consultant and the City of Pompano Beach. The term of the Agreement is fifteen (15) months following final execution of the Agreement.
