BACKGROUND:

The Broward Metropolitan Planning Organization (MPO) approved the funding for the design and construction associated with the Copans Road Mobility project to aid with offering additional multimodal infrastructure. This multiagency project required design, collaboration, and approval from the City of Margate, the City of Coconut Creek, Broward County, and the Florida Department of Transportation (FDOT).

As part of the multiagency effort, the FDOT is providing the design and construction oversight for the Copans Road Mobility Project (FDOT Financial Project ID 429576-5). The proposed improvements include the replacement of the existing sidewalks on Copans Road with a shared-use pathway (8 to 10-feet in width) from SR7/US441 to about NW 49 Terrace. During the design phase, the City Engineer and the design team identified a small section of the proposed shared-use pathway that encroaches outside of the public right-of-way and within the City's property (Government Center). As part of the design and noted on the FDOT Roadway Plans, Sheet No. 15, it illustrates the segment of new sidewalk that encroaches through the northwest corner of the City's government center complex property. For background purposes, the existing 4-foot wide asphalt sidewalk is in the same general location or encroachment within City property. As part of the FDOT Copans Road Mobility Project improvements, this legal instrument is required to allow for the new sidewalk construction to be completed.
