A RESOLUTION AUTHORIZING THE MAYOR, OR DESIGNEE, TO EXECUTE A REVOCABLE LICENSE AGREEMENT WITH BROWARD COUNTY FOR THE PURPOSE OF PROVIDING THE CITY WITH ACCESS TO COUNTY-OWNED LAND (HELENE KLEIN PINELAND PRESERVE AND SAW PALMETTO NATURAL AREA) FOR THE CONSTRUCTION OF SIDEWALK IMPROVEMENTS WITHIN THE RIGHT-OF-WAY OF HILLSBORO BOULEVARD (STATE ROAD 810) ASSOCIATED WITH THE HILLSBORO BOULEVARD REDEVELOPMENT PROJECT.

BACKGROUND:
The City was awarded grant funding through the Broward County Housing Finance and Community Redevelopment Division for public improvements along a segment of Hillsboro Boulevard associated with the Hillsboro Boulevard Redevelopment Project, which improvements consist of: 1,420 linear feet of pedestrian amenities (shared-use pathway), landscaping, irrigation, street furniture, and two (2) bus rider shelters.
The City entered into an Interlocal Agreement (ILA) with Broward County in May of 2020 to receive said funding for these improvements, and subsequently entered into a work authorization with Carnahan, Proctor, and Cross, Inc. in October 2023 for professional engineering services necessary to construct the improvements.
DISCUSSION:
The City desires to provide first class amenities to the users of the Hillsboro Boulevard corridor. The proposed improvements are generally located within the Hillsboro Boulevard right-of-way and/or land owned by Broward County. The Florida Department of Transportation (FDOT) has right-of-way jurisdiction over Hillsboro Boulevard. The design elements proposed as part of this public improvement project are featured items that are above those that are typical FDOT products.
Broward County requires that the City enter into a Revocable License Agreement for access and use of the County-owned property (Helene Klein Pineland Preserve and Saw Palmetto Natural Area) to construct the improvements.
