BACKGROUND:
In November 2023, the City of Coconut Creek approved a site plan application submitted by HSQ Group on behalf of the property owner, for the development of an office/warehouse development complex located on the north side of Atlantic Boulevard at the northwest corner of Lyons Road. The approved site plan provided for public improvements along the West Atlantic Boulevard frontage within the Florida Department of Transportation (FDOT) right-of-way (ROW), including but not limited to, a non-standard FDOT sidewalk (shared-use path), landscaping, and irrigation (collectively referred to herein as "ROW enhancements").
DISCUSSION:
FDOT requires that a local government accept the maintenance of materials and other improvements installed within its right-of-way. This action corresponds with Resolution No. 2025-166, which authorizes execution of Amendment Number Eleven (11) to the FDOT District Four Landscape Inclusive Maintenance Memorandum of Agreement (MMOA), providing for the identified ROW enhancements.
In turn, this agreement assigns the maintenance responsibility for the proposed ROW enhancements to the property owner, Cocomar Property Owner, LCC (the "Property Owner"). All improvements included in this agreement will be constructed and maintained by the Property Owner, in accordance with FDOT standards and City requirements, providing for the long-term maintenance of the Atlantic Boulevard corridor.
