BACKGROUND:

This item was approved at First Reading with no changes or conditions. 

The use of electronic-cigarettes and other vapor producing devices have risen in popularity and the City Commission expressed a desire to address this issue in July, 2014.  At that time, the Commission approved, by consensus, a zoning in progress related to the location of businesses that cater to the retail sale including onsite use of such products.  There was also direction given at that time to have staff come back with an ordinance that addresses the act of smoking electronic cigarettes in places where smoking traditional cigarettes is prohibited.

DISCUSSION:

The City is committed to protecting the health, safety, and welfare of its residents by prohibiting the use of electronic smoking devices in traditionally smoke-free locations such as day care centers, schools, libraries, indoor enclosed workplaces, and city owned or controlled buildings, structures, outdoor seating areas, and/or public transit stations/ stops.

RECOMMENDATION:

Staff recommends approval.
