A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE A TEMPORARY USE AGREEMENT FOR ECONOMIC DEVELOPMENT WITH TT OF SAMPLE, INC. AND TT OF BROWARD, INC. TO PROVIDE FOR TEMPORARY PARKING USE OF CITY PROPERTY.

body

BACKGROUND:

The City of Coconut Creek owns Track E of the Commerce Center of Coconut Creek, commonly known as the Butterfly Parking Lot.  The City and the Seminole Tribe of Florida d/b/a Seminole Indian Casino-Coconut Creek have an ongoing Use Agreement that was approved at the December 14, 2023, City Commission Meeting. This agreement allows the Seminole Indian Casino-Coconut Creek to use this property for continued temporary and non-exclusive overflow parking throughout the year.  The City retains the right to allocate portions of the lot for specific purposes, including but not limited to, temporary parking for other users completing economic development activities.

DISCUSSION:

Infiniti-Lincoln was recently approved to construct a showroom facility in the City.  The construction activities will disrupt the areas currently used for storing cars for sale, and the property owner has asked if the City can accommodate temporary parking on the Butterfly Lot while they complete their showroom construction.

The attached agreement provides for the temporary use of a small portion of the lot during the completion of their construction, which is expected to be completed no later than December 31, 2024.  They will pay to the City the sum of Ten Dollars ($10.00) for the duration of the agreement term, or any portion thereof.  If they are unable to obtain a certificate of occupancy by December 31, 2024, this agreement may be extended at the sole discretion of the City, and they will pay to the City the sum of One Hundred Dollars ($100.00) for each month, or part thereof, of the extension.
