BACKGROUND:

The applicant, Hillsboro Marketplace Investments, LLC, is seeking approval for vacation of easement No. 4, which is the vacation of a portion of a 12-foot Sewer Easement located within a portion of Parcel “A” of the Hillsboro Center No. 2 Plat. 

The property owner wishes to add and develop the existing outparcel development and make site modifications to the overall Marketplace at Hillsboro Plaza (see “Cali Coffee” west outparcel site plan applications).   As such, the proposed development creates conflicts with portions of the identified utility easement.  

DISCUSSION:

The City’s Development Review Committee (DRC) has reviewed this request in conjunction with the proposed site plan.  The City’s Utilities and Engineering Department will coordinate with the applicant on the relocation of utilities that may be located within the vacated easement and the recordation of any new easements that may be necessary for relocated utilities.  As required, the applicant has provided correspondence from affected utility companies. City staff finds that the above described easement vacation is in the best interests of the public welfare.  

RECOMMENDATION:

Staff recommends approval of this resolution.
