BACKGROUND:
The City entered into a Pre-Annexation Agreement with North Broward Preparatory Schools Management II, LTD, now known as North Broward Preparatory Schools, LLC, ("NBPS") on November 17, 1997 ("Pre-Annexation Agreement") providing, among other things, for reimbursement to the City for the expenses incurred in providing public services to NBPS. The Pre-Annexation Agreement was amended by those First and Second Amendments to Pre-Annexation Agreements dated May 13, 2004 and December 9, 2010, respectively, further providing, among other things, for reimbursement to City for certain public services. NBPS has submitted plans to further expand its campus with dormitories and other support buildings which will increase demand for City public services.
Due to increases in demand on City services associated with the expansion of the NBPS campus, NBPS has agreed to pay City a "Public Services Reimbursement Fee" for all new permanent buildings constructed on the campus in excess of the current 218,029 square feet of existing building space. The Public Services Reimbursement Fee is in addition to, and not in lieu of, any other payment or obligation owed by NBPS to the City.
DISCUSSION:
The City is committed to recovering costs incurred in providing additional demand on public facilities and services attributable to the construction of new buildings and expansion of uses on the NBPS property.
