BACKGROUND:

During the 2021 Florida Legislative Session, the Community Planning Act was amended to mandate that every city and county comprehensive plan in the State of Florida add a property rights element; and as such, the City of Coconut Creek must amend the City’s Comprehensive Plan to add the state-mandated Property Rights Element, which will consist of a new goal, objective, and policies pursuant to Florida Statutes §163.3177(6)(i)1.

DISCUSSION:

The State Department of Economic Opportunity (DEO) provided minimum guidelines, which have been incorporated into the proposed draft element. Consistent with the state requirements, the proposed new element incorporates existing property rights and protections into the City’s Comprehensive Plan.

Following the first reading and public hearing on the proposed amendment, City staff will transmit the proposed amendment to various state and regional planning review agencies for review and comment. City staff will make revisions, if any, per those agency comments and then schedule a second reading of the proposed ordinance to adopt the Property Rights Element.     

RECOMMENDATION:

The Planning and Zoning Board, at its May 10, 2023, meeting, recommended approval of the ordinance to adopt the Comprehensive Plan Amendment.

City staff recommends approval of this ordinance to adopt the mandated Comprehensive Plan Amendment.
