A RESOLUTION APPROVING THE SECOND AMENDMENT TO THE INTERLOCAL AGREEMENT (ILA) WITH THE SOLID WASTE DISPOSAL AND RECYCLABLE MATERIALS PROCESSING AUTHORITY OF BROWARD COUNTY, FLORIDA PROVIDING FOR ADDITIONAL OPT OUT OPPORTUNITIES FOR CITIES; AND AUTHORIZING THE MAYOR, OR DESIGNEE, TO EXECUTE SAME.

BACKGROUND:
In 2019, Broward County and participating Broward County Municipalities entered into a Memorandum of Understanding (MOU), providing for a collaborative study and subsequent development of an integrated solid waste and recycling system, and establishing a Solid Waste Working Group (SWWG), consisting of a group of elected municipal officials chosen from among the elected officials of the participating Broward County Municipalities and a County Commissioner.
In 2022, the SWWG agreed to engage a consultant to perform a waste generation study to further its efforts to agree on a regional solution for the future of solid waste disposal and the processing of recyclable materials. The County hired the consultant and contributed fifty percent (50%) of the costs, while the participating municipalities paid the remaining fifty percent (50%) based upon population.
On May 25, 2023, the Coconut Creek City Commission, through Resolution No. 2023-090, approved the Interlocal Agreement for Solid Waste Disposal and Recyclable Materials Processing Authority of Broward County, Florida ("ILA"), the purpose of which was to create a Solid Waste Authority (the "Authority"), to develop a plan (known as a "Master Plan") to implement a long-term, environmentally-sustainable, economically-efficient plan and approach to disposal, reduction, recycling, and reuse of waste generated in Broward County including establishing ownership of such facilities.
On April 23, 2026, through Resolution No. 2026-060, the City Commission approved the First Amendment to the ILA (Facilities Amendment), committing the City to participation in the Solid Waste Authority ...
